These SMS Terms ("SMS Terms") explain how text messaging works when you receive messages directly from Text.st or communicate with a service business using Text.st-powered messaging.
Text.st AI helps service businesses respond to website leads, answer questions, understand customer needs, manage conversations, and support bookings by SMS.
By providing your mobile number and affirmatively opting in where consent is required, requesting a text conversation, texting an enabled number, or otherwise initiating an SMS interaction, you agree to these SMS Terms and any program-specific disclosures presented to you at the time of opt-in.
These SMS Terms supplement the Text.st Terms of Service and Text.st Privacy Policy. If a service business is identified as the sender, that business's own terms and privacy notice may also apply.
1. Who is sending the messages
There are two types of messaging relationships covered by these SMS Terms:
1.1 Messages from Text.st
Text.st may send messages directly to Text.st Customers, prospective Customers, or authorized account users. In that relationship, Text.st is the sender, and questions may be directed to support@text.st.
1.2 Messages from a Text.st Customer
A service business may use Text.st to communicate with its own prospective or existing customers ("End Users"). In that relationship:
- the business identified in the opt-in disclosure or message is the sender;
- Text.st provides the technology used to facilitate the conversation;
- the business determines the message purpose, content, recipients, and follow-up; and
- the business is responsible for its services, offers, quotes, appointments, and relationship with the End User.
Each Text.st-powered messaging program is specific to the identified business and approved use case. Text.st does not use one shared master identity to send messages for unrelated businesses. Consent given to one business or messaging program does not authorize messages from another business or program.
2. How you may opt in
Depending on the program, you may opt in or request messages by:
- entering your mobile number in a website form or Text.st-powered widget and selecting the applicable consent control;
- requesting a quote, callback, booking, support conversation, offer, or other text response;
- texting a keyword or sending a message to an enabled number;
- providing written or electronic consent through another clearly disclosed method; or
- separately agreeing to receive promotional text messages.
The opt-in disclosure should identify the sender, describe the message purpose, explain expected frequency, state that message and data rates may apply, explain how to opt out or get help, and link to applicable terms and privacy information.
Consent to receive marketing or promotional text messages is not a condition of purchasing goods or services. Transactional or service-related messages may be sent when you request them, when they are necessary to complete an interaction, or where another lawful basis applies.
You may withdraw consent at any time as described below.
3. Types of messages
Messages may include:
- responses to website inquiries or text messages;
- answers to questions about a business, service, availability, or policy;
- quote, estimate, callback, and service-request follow-ups;
- lead-conversation and customer-support messages;
- appointment availability, booking confirmations, reminders, changes, and cancellations;
- requested information about an offer or promotion;
- account, onboarding, security, usage, billing, compliance, and service notices from Text.st; and
- marketing or promotional messages where the recipient has provided the consent required by law.
The message categories you receive depend on what you requested and the disclosures shown when you opted in.
4. Automated technology and Text.st AI
Messages may be sent using automated technology. A Text.st Customer may use Text.st AI to draft or send replies, summarize conversations, identify service needs, organize leads, suggest next steps, or support bookings.
Text.st AI can make mistakes. Important information—including services, prices, availability, deadlines, policies, and appointment details—should be confirmed with the business. A Customer can pause automated replies and take over a conversation.
Text.st AI does not provide legal, medical, financial, tax, emergency, or other professional advice and is not intended to make decisions that create legal or similarly significant effects.
Your consent to receive marketing messages through automated technology is not a condition of purchase.
5. Message frequency
Message frequency varies based on the program and your interaction. A conversation you initiate may generate multiple messages as the business answers questions, gathers information, offers times, confirms a booking, or provides requested support.
Promotional-message frequency will be described in the applicable opt-in disclosure. Text.st and its Customers should not send messages materially beyond the frequency or purpose reasonably described to you without obtaining any additional consent required by law.
6. Message and data rates
Text.st does not charge End Users a separate fee merely for opting in to receive text messages. Standard message, data, roaming, or other charges imposed by your mobile service provider may apply. Contact your mobile service provider for information about your plan.
Any fees for a Customer's underlying products or services are determined by that Customer and are separate from mobile messaging charges.
7. How to opt out
You may opt out at any time by replying STOP to the number sending the messages. Recognized opt-out words may also include QUIT, END, REVOKE, OPT OUT, CANCEL, and UNSUBSCRIBE.
You may also use any other reasonable method that clearly communicates your request to stop, such as contacting the identified sender through a published support channel. No sender may require STOP to be the exclusive opt-out method where applicable law recognizes another reasonable request.
After an opt-out request:
- the sender will stop covered messages within the period required by law;
- you may receive one final, non-promotional confirmation that your request was processed; and
- the sender may retain a limited suppression record to ensure your preference continues to be honored.
If an opt-out request is unclear about which program it covers, the sender may send one non-promotional message asking you to clarify. If you do not respond, the sender will apply the opt-out as required by applicable law.
An opt-out generally applies to the business or sender identified in the applicable messaging program. If you separately opted in to messages from another business, you may need to opt out from that sender separately, except where applicable law requires a broader result.
Opting out of promotional messages does not prevent messages that are legally permitted without marketing consent, such as a direct response you later request, a security notice, or another message required by law. A sender will not use this exception to continue marketing after an opt-out.
8. How to get help
Reply HELP to the number sending the messages for available assistance or sender contact information.
For a Text.st Customer's messaging program, contact the business identified in the message, opt-in disclosure, or linked website. That business is best positioned to answer questions about its services, appointments, quotes, or offers.
For messages sent directly by Text.st, or for a technical or privacy concern involving Text.st, email support@text.st.
9. Your mobile number
By providing a mobile number, you represent that:
- the number is accurate;
- you are the subscriber, customary user, or otherwise authorized to provide consent for that number; and
- you will notify the applicable sender or opt out if you stop using, transfer, or reassign the number.
Mobile numbers can be reassigned. If you receive messages intended for a previous user, reply STOP and, where helpful, tell the sender that the number has been reassigned.
10. Customer responsibilities
Businesses using Text.st must:
- identify themselves accurately in opt-in disclosures, registration materials, and messages;
- send messages only when they have the required consent or other lawful basis;
- keep evidence of consent;
- describe message purpose and frequency accurately;
- honor STOP and other reasonable revocation requests;
- maintain suppression records;
- provide required terms, privacy, rate, frequency, and HELP disclosures;
- keep A2P 10DLC, toll-free, campaign, number, and carrier-registration information current; and
- comply with applicable laws, carrier rules, and messaging-industry requirements.
Text.st provides consent, opt-out, HELP, and compliance tools, but each Customer remains responsible for its messaging practices. A Customer may not use Text.st for spam, purchased or scraped contact lists, unlawful messaging, unapproved bulk campaigns, sender impersonation, opt-out evasion, or prohibited content.
11. Privacy and mobile-information protection
The Text.st Privacy Policy explains how Text.st processes contact details, message content, consent records, device information, bookings, and related data.
Text.st does not sell, rent, or disclose mobile phone numbers, SMS opt-in data, or messaging-consent records to third parties or affiliates for their own marketing or promotional purposes.
This information may be disclosed only:
- to the business on whose behalf the communication occurs;
- to providers, networks, and carriers that help route, deliver, secure, or support messaging;
- to registration, vetting, fraud-prevention, or compliance organizations;
- at your direction; or
- where required by law.
Text.st and its Customers may maintain consent and opt-out records to operate the messaging program, honor preferences, investigate complaints, and demonstrate compliance.
12. Availability and carrier limitations
Messaging availability depends on your country, mobile service provider, device, plan, number type, network conditions, sender approval, and carrier policies. Not all programs or features are available on every carrier or in every location.
Messages may be delayed, filtered, blocked, duplicated, reordered, or undelivered. Text.st, its Customers, and participating carriers do not guarantee delivery, timing, or uninterrupted availability. Mobile service providers and carriers are not liable for delayed or undelivered messages to the extent permitted by law.
Text.st or the sender may change the number used for a program. If reasonably practicable, notice will be provided before a material change. Opt-out requests and suppression records will be handled as required by law.
13. No emergency use
Do not use Text.st-powered messaging for emergencies, urgent life-safety needs, or to contact 911 or another emergency service. Text messages may not be read or delivered promptly. If you or another person may be in danger, contact the appropriate emergency service directly.
14. Age requirements
Text.st messaging is not directed to children under 13. If you are under 18, you may participate only with the permission of a parent or legal guardian and where permitted by law.
Businesses must not knowingly use Text.st to collect or process children's personal information in violation of applicable law.
15. Ending or changing a messaging program
Text.st or a Customer may suspend, change, or end a messaging program because of business changes, carrier requirements, security concerns, legal obligations, abuse, or service discontinuation.
We may update these SMS Terms to reflect changes in the Services, law, carrier requirements, or messaging practices. Updated terms will be posted with a revised "Last updated" date. Material changes will receive additional notice where required. A material change will not retroactively expand marketing consent where new consent is required.
16. Relationship to other terms
For Text.st Customers and account users, the Text.st Terms of Service govern the use of the Text.st platform, including billing, acceptable use, liability, and dispute resolution.
For End Users communicating with a Text.st Customer, the Customer's terms, privacy notice, booking policies, and service conditions may apply to the relationship between the End User and that Customer. Text.st is not a party to the Customer's products, services, appointments, sales, or disputes.
If these SMS Terms conflict with program-specific disclosures, the more specific disclosure controls for that program, except that it cannot reduce rights or protections required by law.
17. California law
For matters involving Text.st that are not governed by mandatory law or the dispute-resolution provisions of the Text.st Terms of Service, these SMS Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute with Text.st that is permitted to proceed in court must be brought in the state or federal courts located in Los Angeles County, California. Nothing in this section limits consumer or privacy rights that cannot lawfully be waived or determines the law governing a separate dispute between an End User and a Text.st Customer.
